1. Agreement to Terms

By accessing or using the services of Shoebox Hero Collectibles LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. If you do not agree to these Terms, you may not use our services. These Terms apply to all visitors, users, and others who access or use our card evaluation, cash offer, consignment, and grading services.

2. Description of Services

Shoebox Hero provides card concierge services, including but not limited to: initial photo based evaluations via email, cash offers for collections, consignment sales, and grading preparation and submission to third party grading services. We act as an agent on your behalf and may also purchase collections outright when a cash offer is accepted and confirmed in writing.

3. Eligibility

You must be at least 18 years old and capable of entering into a binding contract to use our services. By submitting cards to us, you represent and warrant that you are the lawful owner of the cards or have explicit authorization from the owner to engage our services.

4. Submission & Shipping

Initial intake is handled by email. Once you approve a path, we provide insured prepaid shipping materials and labels for sending your cards to our facility. You are responsible for packing cards securely according to our guidelines. Insurance coverage is provided up to the declared value you specify. We are not liable for damage or loss during transit to our facility if you fail to use our provided materials or follow our packing instructions.

5. Evaluation & Appraisal

Our appraisals are based on photos or videos, market data, condition assessment, and professional expertise. All valuations are estimates and not guarantees of sale price. Card markets fluctuate, and actual sale prices may differ from initial appraisals. We will provide a detailed breakdown of recommended actions for each card or lot.

6. Cash Offers

Cash offers are based on estimated market value and condition. An offer is not binding until accepted by you and confirmed by us in writing. Upon acceptance and receipt of your cards, we inspect to confirm condition matches the description. If condition differs materially, we may adjust or rescind the offer. If you decline a final offer, we will return your cards at our expense.

7. Grading Submissions

We prepare and submit cards to PSA and other third party grading services on your behalf. Turnaround times are estimates based on current service levels and are not guaranteed. Grading results are determined solely by the grading company; we have no control over or influence on assigned grades. Once submitted, cards cannot be recalled until grading is complete.

8. Fees & Commissions

Our compensation is structured as a commission on successful consignment sales or as a purchase price in cash offer transactions. Specific commission rates will be outlined in your Service Agreement. You are responsible for all third party fees, including but not limited to PSA grading fees, auction listing fees, and payment processing fees. These fees are deducted from proceeds before payout or invoiced separately as agreed.

9. Sale & Payout

We list cards across high velocity auction platforms and marketplaces. Sale timelines vary based on market demand. Upon successful sale, we will remit proceeds (less agreed fees and commissions) within 14 business days of funds clearing. You are responsible for providing accurate payment information. We are not responsible for delays caused by payment processors.

10. Unsold Cards & Returns

If cards remain unsold after an agreed consignment period, you may elect to have them returned to you at your expense, re-listed, or donated as we mutually agree. Cards not claimed within 90 days of written notice may be subject to storage fees or disposal at our discretion.

11. Risk & Liability

While we exercise extreme care in handling your cards, we are not liable for inherent risks of the collectibles market, including but not limited to: grade unpredictability, market downturns, auction platform issues, or force majeure events. Our maximum liability for any claim is limited to the lesser of the card's insured value or the fees you paid for our services.

12. No Financial Advice

Our recommendations regarding grading, holding, or selling cards are based on market knowledge and experience but do not constitute financial, investment, or tax advice. You should consult qualified professionals for investment or tax guidance. Past performance of card markets is not indicative of future results.

13. Intellectual Property

All content on our website, including text, graphics, logos, and images, is our property or used with permission and is protected by copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our express written consent. We may use photographs of your cards for marketing purposes unless you opt out in writing.

14. Termination

Either party may terminate the service relationship with written notice. You remain responsible for all fees incurred prior to termination. Cards already submitted for grading or listed for sale will be completed according to existing agreements unless both parties agree otherwise.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles. Any disputes arising from these Terms or our services shall be resolved through binding arbitration in Delaware, except that either party may seek injunctive relief in court.

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services after changes constitutes acceptance of the revised Terms. Material changes will be communicated via email if you have provided contact information.
